Welcome to Petrolfans Store – Adam Pekala x Vintage Motoring (later abbreviated to “Petrolfans Store”, “the Shop”, “we”, “our”, or “us”). These Terms and Conditions (later “Terms”) govern your use of our website https://www.petrolfans.com/, specifically https://www.petrolfans.com/store/ (the “Website”) and the purchase of any products from our online store. By accessing our Website or making a purchase, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Website or purchase our products.

1. General Information

1.1. Petrolfans Store is an online fine art print shop based in Europe. We offer a variety of bespoke fine art prints, shipped worldwide.

1.2. These Terms apply to all users of the Website, including but not limited to browsers, vendors, customers, merchants, and/or contributors of content.

1.3. We reserve the right to update, change, or replace any part of these Terms by posting updates or changes to our Website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the Website following the posting of any changes constitutes acceptance of those changes.

2. Products and Services

2.1. All products on our Website are fine art prints and are made to order. They are therefore considered bespoke or personalized items.

2.2. Products offered on our Website are exclusive, limited items produced in numbers indicated in the selection of fine art print size. We oblige never to produce more stock than indicated and when the run is sold out, no re-printing will ever be done. This is validated by a certificate of authenticity issued to each of the prints.

2.3. We make every effort to display the colours and images of our products accurately. However, we cannot guarantee that your computer monitor's display of any colour will be accurate.

2.4. We reserve the right to limit the sales of our products to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis.

3. Orders and Payment

3.1. All orders are subject to acceptance and availability. We reserve the right to refuse any order for any reason.

3.2. Prices for our products are subject to change without notice. We reserve the right to modify or discontinue any product at any time without notice. Please note that this will not impact the quantity in any adverse way, e.g. if a product is limited to 10 pieces, we might stop production after 5 units, but we will never produce more than 10. Your fine art print can only get more exclusive.

3.3. We use Squarespace to power our online store. By agreeing to these Terms, you acknowledge and agree that the availability and functionality of the Website are dependent on the services provided by Squarespace. We take no responsibility for any malfunctions, errors, or service interruptions caused by Squarespace or any third-party service providers.

3.4. Payments are processed securely through our payment partners. We do not store credit card details, and we take no responsibility for any issues arising from payment processing.

4. Shipping and Delivery

4.1. We ship worldwide using external shipping providers. The shipping cost will be calculated at checkout based on your location and the size and weight of your order.

4.2. Delivery times are estimates and not guaranteed. We are not responsible for delays caused by customs, postal services, or other external factors beyond our control.

4.3. Once your order has been handed over to the shipping provider, all risk and responsibility for the shipment are transferred to the shipping provider. We unfortunately do not take responsibility for any loss, damage, or delay caused by the shipping provider, but we will do our best to assist you in an unlikely scenario of shipping issues.

4.4. Each print is made to order to ensure highest quality. Whilst we are working hard to dispatch your order as soon as possible, please allow 7-10 days for unframed prints and 21-28 days for framed fine art from order to dispatching shipping.

4.5. Framed orders are shipped in a wooden shipping crate made to measure for your fine art print, to ensure safe transportation. A screwdriver might be required to open the crate, and this tool is not provided in the order. After unpacking, you can keep the shipping crate for future transportation or storage of your fine art or if you decide to dispose of it, please recycle.

5. Customs, Duties, and Taxes

5.1. All orders shipped outside of Europe, European Union (EU) or European Economic Area (EEA) may be subject to customs duties, taxes, and other fees imposed by the destination country. These charges are the responsibility of the customer and must be paid by the customer upon delivery.

5.2. We are not responsible for any customs delays, duties, taxes, or fees that may be incurred during the shipping process.

6. Returns and Refunds

6.1. Due to the bespoke and made-to-order nature of our products, all sales are final. We do not accept returns or exchanges under any circumstances.

6.2. In the unlikely event that you receive a damaged or defective product, it should be reported directly to the shipping provider upon receipt of the package. If damages are not reported to the shipping company, we cannot guarantee a refund as packages are insured in transit. In any case, please contact us within 7 days of receipt with your order number and photos of the damage. We will assess the issue and, if deemed necessary, work together to find the best solution.

7. Limitation of Liability

7.1. To the fullest extent permitted by law, Petrolfans Store shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, or data, arising out of or in connection with your use of the Website or purchase of any products.

7.2. We do not guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, secure, or error-free. You agree that from time to time we may remove the service for indefinite periods or cancel the service at any time, without notice to you.

7.3. Our total liability to you for any claim arising out of or in connection with these Terms shall not exceed the amount paid by you for the product(s) purchased from us.

8. Intellectual Property Rights

8.1. All content on the Website, including but not limited to text, graphics, logos, images, and software, is the property of Petrolfans Store or its content suppliers and is protected by intellectual property laws.

8.2. You may not use, reproduce, distribute, or create derivative works from any content on the Website without our express written permission.

9. Governing Law

9.1. These Terms shall be governed by and construed in accordance with the laws of Denmark, without regard to its conflict of law principles.

9.2. Any disputes arising out of or relating to these Terms shall be resolved exclusively in the courts of Copenhagen, Denmark.
